He says that Data Protection remains a key battleground and that ‘the case law and new legislation is all likely to strengthen the position of claimants seeking to protect their right to privacy’. The Data Protection Act is being used as ‘a weapon’ in court battles, but is a huge grey area that ‘needs to be understood properly… it’s a very dense piece of European legislation,’ Crossley says.
