Dadswell points to the use of corporate governance in managing family wealth as a major growth area — assuming a role trust structures had prior to changes in trust taxation — while new anti-money laundering legislation, trust and ultimate beneficial owner registers for corporates are extending the obligation to collect information on clients to legal advisers ‘and even to do HMRC’s job for it’, she says. ‘HMRC now has some very sophisticated data mining software in its armoury, and new and onerous penalty regimes extending to client and advisor alike. Given the firepower HMRC now has, and that the political will is very much in their corner, our job is now, more than ever, concerned with ensuring that clients’ affairs are structured and managed in a way that is both efficient and defensible.’
