Former silk Posnansky describes the past twelve months as a ‘blur’, following a rush of litigation and jurisdiction disputes. He laments, perhaps unsurprisingly, the slow take-up of arbitration, saying that although clients don’t pay a judge as they would an arbitrator, they need to ‘understand why it’s different, why it’s better. We had one recently that went very well.’ After 35 years at the bar, he’s now got ‘the best of both worlds’, although he still uses external counsel and QCs: ‘I’m absolutely not arrogant, I don’t always take my own advice.’ Even so, he was at the Court of Appeal for Yasmin Prest in a case with implications for spouses pursuing commercial assets of the other party
